Welcome to Bug Badges (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our website at bugbadges.com (the “Site”) and your purchase and use of Bug Badges products and subscriptions (collectively, the “Services”).

By accessing or using the Site or purchasing from us, you agree to be bound by these Terms. If you do not agree, you may not use the Site or purchase our products.

1. Eligibility

By using this Site, you represent that:

  • You are at least the age of majority in your state or province of residence, or

  • You are using the Site under the supervision and with the consent of a parent or legal guardian.

Our products are designed for children, but are purchased and managed by adults. You must be an adult to place an order.

2. Online Store Terms

You agree not to use our products or the Site for any illegal or unauthorized purpose, and you may not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms, viruses, or any destructive code. A breach or violation of any of the Terms will result in an immediate termination of your access to the Services.

3. Orders, Pricing & Payment

All prices listed on the Site are in U.S. dollars unless otherwise stated.

  • We reserve the right to change prices, products, or descriptions at any time without notice.

  • We may limit or cancel quantities purchased per person, per household, or per order at our sole discretion.

  • We reserve the right to refuse any order you place with us.

If we make a change to or cancel an order, we may attempt to notify you using the email and/or billing address/phone number provided at checkout.

You agree to provide current, complete, and accurate purchase and account information for all purchases made through our Site.

4. Subscriptions & Recurring Billing (If Applicable)

Some Bug Badges products may be offered as subscriptions with recurring billing.

By starting a subscription:

  • You authorize us (and our payment processor) to charge your chosen payment method on a recurring basis (e.g., monthly or as otherwise stated at checkout).

  • Your subscription will continue until you cancel it in accordance with our cancellation policy.

Managing your subscription

You can manage or cancel your subscription through your account on the Site (if available) or by contacting us at support@bugbadges.com.

  • Cancellations apply to future charges only and must be made before the next billing date.

  • Charges for past periods or already-processed orders are non-refundable, except as described in our Refund & Return Policy.

Details on billing frequency, pricing, and included products are listed on the applicable product or subscription page at the time of purchase.

5. Shipping

We ship to the locations listed on our Site. Estimated shipping times and available shipping methods will be shown at checkout.

  • Shipping times are estimates only and are not guaranteed.

  • We are not responsible for delays caused by carriers, customs, weather, or events beyond our control.

If your package appears to be lost or significantly delayed, please contact us at support@bugbadges.com and we will work with you to investigate and, where appropriate, arrange a replacement or refund in line with our policies.

6. Refunds, Returns & Cancellations

Replacements & Order Issues
We want you and your kids to be happy with Bug Badges. If:

  • Your order arrives damaged,

  • An item is missing, or

  • You receive the wrong kit,

Please contact us within 14 days of delivery. We’ll offer a replacement shipment or a refund/credit, depending on the situation.

Lost Packages
If your package appears to be lost in transit, please reach out to us. We’ll help track it and, if necessary, arrange a replacement or refund.

Order Cancellations

  • You may request a cancellation before your order has shipped.

  • Once an order has been packed and handed off to the carrier, it can no longer be cancelled or refunded, but we will still replace any items that arrive damaged, incomplete, or incorrect.

To request a cancellation, contact us with your order number as soon as possible.

7. Nature & Safety Disclaimer

Bug Badges encourages children to notice and observe insects in the real world. However, outdoor exploration and contact with wildlife always involve some level of risk.

Adult supervision required

Bug Badges kits and activities are designed to be used under the supervision of a responsible adult. Adults are responsible for choosing safe locations, supervising children during outdoor activities, and deciding what is appropriate for each child.

Do not handle insects

We recommend that children do not touch, pick up, or handle insects at all. Insects can bite, sting, or cause allergic reactions, and many species are difficult for non-experts to identify correctly.

Instead, we encourage:

  • Observing insects from a safe distance

  • Leaving insects where they are found, without capturing or disturbing them

Environmental and situational safety

You are responsible for ensuring that children avoid dangerous environments and behaviors, including but not limited to:

  • Roads, parking lots, and other traffic areas

  • Steep terrain, cliffs, or unstable ground

  • Deep or fast-moving water

  • Private property without permission

  • Areas with known hazards (e.g., venomous animals or plants)

Health & allergy considerations

Bug Badges cannot assess or manage individual health risks. If a child has any history of allergies (including insect stings or bites), asthma, or other health concerns, you should consult an appropriate medical professional before participating in Bug Badges activities.

No professional advice

All information in Bug Badges kits, cards, and on our Site is for educational and recreational purposes only. It is not intended as medical, safety, or scientific advice. We do not guarantee that species depicted or described in our materials are safe to approach or observe in all locations or circumstances.

By using Bug Badges kits, you acknowledge that outdoor exploration and wildlife observation carry inherent risks, and you agree that you are responsible for supervising participating children, using good judgment, and following any local rules and guidelines.

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, icons, images, product designs, and artwork, is owned by Bug Badges or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Site without our prior written permission, except as needed for personal, non-commercial use of our products.

“Bug Badges” and any related logos, names, or designs are trademarks or service marks of Bug Badges. Unauthorized use is strictly prohibited.

9. User Content & Feedback

If you send us ideas, suggestions, feedback, photos, reviews, or other materials (“User Content”), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, and display such content for marketing, product improvement, or other business purposes, subject to any additional consent or releases we request (especially for content featuring children).

You represent and warrant that:

  • You own or control the rights to any User Content you provide; and

  • Your User Content does not infringe the rights of any third party or violate any law.

10. Third-Party Services & Links

Our Site may include links to third-party websites, services, or tools that we do not control.

We are not responsible for the content, policies, or practices of any third-party websites or services. Your use of third-party sites is at your own risk and subject to their terms and policies.

11. Prohibited Uses

You may not use the Site or our products:

  • For any unlawful purpose;

  • To solicit others to perform or participate in unlawful acts;

  • To violate any international, federal, or state regulations, rules, laws, or local ordinances;

  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others;

  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate;

  • To submit false or misleading information;

  • To upload or transmit viruses or any other malicious code;

  • The results that may be obtained from the use of the Services will be accurate or reliable; or

  • Any defects in the Services will be corrected.

13. Limitation of Liability

To the maximum extent permitted by law, Bug Badges, our owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Site or any products purchased from us.

In no case shall our total liability to you for all damages, losses, and causes of action exceed the amount you paid us for the product(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Bug Badges and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

15. Governing Law

These Terms and any separate agreements by which we provide you products or services shall be governed by and construed in accordance with the laws of the State of South Carolina, USA, without regard to its conflict of law provisions.

We reserve the right to update, change, or replace any part of these Terms at any time by posting updates on this page. The “Last updated” date at the top will indicate when changes were last made.

Your continued use of the Site or purchase of our products following the posting of any changes constitutes acceptance of those changes.
